RESUMO:

This socio-legal research describes and analyzes the migratory policy on refugees currently in Brazil, examines the national legal framework in this area and the policies of social inclusion with this diaspora in accordance with compliance with the international human rights law and international principles for refugees. In accordance with the hypothesis that the protection of the life, integrity and freedom of a refugee as a human being is equal to any other Brazilian citizen or regular migrant, these rights being configured as superior values that must be protected against any other variable. Considering that Brazil is facing a complex situation caused by the massive flow of high vulnerable refugee applicants, it is proposed to carry out a three-pronged study. The first part is an analysis of the compliance of the principle 101of non-refoulement established as jus cogens and the key elements of determining refugees eligibility facing "crimigration" practices; the second part is a reflection on the theoretical and methodological foundations of the concepts of habitus and capital of the Theory of  Practice of Pierre Bourdieu, which helps in an applied analysis on the characterization of sociodemographic profiles of  the refugees recognized by the Brazilian State; the third part  is the identification of the public policies carried out by CONARE for the social inclusion of this diaspora and its complexity by their implementation. At the same time, this work seeks to analyze trough these issues the elements of social esteem, acculturation and durable solutions for refugees.
