SUMMARY:

The main objective of the research is to analyze the political-ideological dimension of historical denialism and the potential of the juridification of the past as a means of confronting this phenomenon. For this purpose, it starts from the recognition that there are issues related to the production of history and memory that reverberate beyond the historiographical field. This is the case of the falsification of the past for political and ideological purposes, which can serve to spread hate speech and legitimize authoritarian postures. The development of the research comprises two stages: the first aims to characterize historical denialism, its “methods” of producing untruths and the dangers it represents, from a History of the Present that highlights Bolsonarist denialism and its similarities and differences with the denialism that emerged after the Second World War; the second part is based on the analysis of legal documents, such as laws and procedural documents, and discusses possible impasses caused by the punishment of historical denialism and, above all, the possibilities of confronting the phenomenon through the called memorial laws. As a hypothesis, it is accepted that the formulation of politics of not-forgetting violent past and broadening the horizon of expectations regarding the consolidation of a democratic society, which does not naturalize oppression, constitutes one of the main fronts against denialism. In this sense, the thesis intends to be an interdisciplinary theoretical debate, based especially on the study of History and Law, capable of giving rise to other research aimed at the elaboration of politics of the past and the study of the “architecture” of denialism.
