This master's dissertation addresses issues related to the process of recovery, struggle and resistance of the Tupinambá indigenous people of Belmonte. The Tupinambá de Belmonte Indigenous Land (TI) is a territory in judicial dispute for more than two decades between heirs and indigenous people. The areas comprise the Timiquim Farm, on the left bank of the Jequitinhonha River, in the district of Boca do Córrego, city of Belmonte-BA. In this place is located the Patiburi Village, where about 100 (one hundred) Tupinambá indigenous live. In the disputes are also another 03 (three) farms, which formed an "agricultural enterprise", a company called EH de Souza Ceolin - Fazenda Três Lagoas - ME, composed of Fazendas São José do Triunfo, Fazenda São José do Triunfo 2 and Fazenda Eldorado , all contiguous and with different registrations. In this context of agrarian conflicts between indigenous people and landowners, the role of the State is inserted, which at times was as an oppressor, removing indigenous people from their territory in order to guarantee the white people's law, and soon after as a protector of the life of this population in guaranteeing the right to land and the lives of the Tupinambá indigenous people of Belmonte. The Indigenous Land (TI) of Belmonte has already been recognized by the Detailed Report on Identification and Demarcation (RCID) as a land traditionally occupied by the Tupinambá of Belmonte since its publication in the Official Gazette on April 23, 2013. The research seeks to dialogue with the sources, historical and anthropological, supported by documentary and oral sources of the Tupinambá people, as well as the entire framework of judicial processes in the demonstration of resistance and struggles in an antagonistic process and delay of the Brazilian State in concluding the long administrative process of demarcation of the Tupinambá Indigenous Land of Belmonte that has dragged on for more than two decades.
